RE: The tariff classification of an alarm clock radio from China

Dear Ms. Vair:

In your letter dated May 4, 2015, on behalf of Gibson Innovations USA, you requested a tariff classification ruling.

The merchandise under consideration is a digital alarm clock radio, model AJ3116M. This alarm clock radio, which has a built-in FM tuner, contains a battery backup feature to ensure memory of time during power failures, but is not capable of operating without an external source of power. It does not contain any sound recording or reproducing apparatus and is valued less than $40 each.

The applicable subheading for this alarm clock radio will be 8527.92.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Reception apparatus for radiobroadcasting, whether or not combined, in the same housing, with sound recording or reproducing apparatus or a clock: Other: Not combined with sound recording or reproducing apparatus but combined with a clock: Valued not over $40 each. The rate of duty will be Free.

In reference to your request for the classification ruling of the Bluetooth speakers and the Bluetooth headphones, please be advised that the classification of similar merchandise is currently being reviewed by R&R at CBP Headquarters. As such, this office is precluded from ruling on the classification of this merchandise.

You may, however, resubmit your request for a prospective classification ruling of these items upon the publication of a final ruling determination by CBP Headquarters.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
